ANTHONY VAN ZANTWIJK
"After matriculating at St John's College and completing a BSc (Civil) Eng at the University of the Witwatersrand (Wits) in 1996, I joined Stephenson & Associates, a firm specialising in hydraulic engineering. My stint as an engineer did not last long before opting to enroll for an LLB full time at Wits in 1998.
During 2001, I completed my law degree cum laude (assisted financially by the Anna F Klotz (1999) and Deneys Reitz (2000) scholarships) and joined Spoor & Fisher, specialising in the commercialisation and valuation of intellectual property, ultimately qualifying as a patent attorney in 2002.
After four enjoyable years, I left Spoor & Fisher as a senior associate and joined the Special Projects department at the South African Revenue Services (Large Business Centre, Johannesburg) tackling intellectual property valuations, tax issues relating to intellectual property and structured finance transactions in general. By the end of 2006 I had completed my LLM (coursework) in tax (Wits) (submitting a thesis entitled “Sale and Leaseback of Intellectual Property – Tax Avoidance or Tax Evasion?”) and development of various intellectual property valuation models currently used by SARS and SARB.
During January 2007, McLean and I teamed up to establish Sibanda & Zantwijk.
Despite returning to private practice, I remain involved in assisting South African Treasury to regulate the dynamics between IP, tax and exchange controls, consulting to Treasury on s11D (R&D incentive), s23I (royalty arbitrage) and s31 (transfer pricing) of our Income Tax Act.
As from 2008, I have been privileged to: lecture the IP Tax module for the Wits HDip (Tax) course and the IP commercialisation and valuation modules in the Wits LLM (Intellectual Property) course; and contribute chapters on IP tax for publication in the Practical Tax Handbook.”
