Incoming licences

All technology “incoming licences” (i.e. foreign owned intellectual property licensed to South African entities) relating to the manufacture of products in South Africa require DTI approval, which is typically granted for a period of 5 years. The guideline published as form DTP001 caps royalty payments and filters-out “undesirable” clauses.

All other incoming licences must be submitted to the South African Reserve Bank for approval.

See our article discussing forms of transactions that require Exchange Control approval.
